Class Action Lawsuits: Class Action is a formalized legal action whereby a representative member of a class of plaintiffs, whose claim has arisen out of the same set of facts, is allowed to represent the class as a whole in litigation.
The first step in the process is when a representative member of a class seeks to have the "class" certified by a judge. After a period of fact finding (discovery) the court determines whether there is adequate evidence to certify a class.
The judge will determine if the common issues predominate over individual issues. Are the main issues leading to the cause of action substantially more similar than unique? Individual Plaintiff's are allowed to "Opt Out" if they feel their interests would be adversely affected by participating in the "Class."
