Products Liability
Products Liability Lawsuits: Products liability refers to the legal liability of manufacturers and sellers to compensate buyers, users and even bystanders for damages or injuries suffered as a direct result of the use of items purchased or used.
If you have been injured because of a dangerous or defective product, you may be entitled to monetary compensation for your pain and suffering. These damages could include physical injury, emotional damage and financial loss because of unsafe products and negligence of product manufacturers and suppliers.
There are two primary categories of products liability lawsuits. One is where the injury is the result of a dangerously designed products, the other is when the injury is the result of a defective product.
Dangerous Design: This is when a product's design is inherently dangerous when used for its intended purpose, or if the warnings of the possible dangers are not adequately delivered. In other words, the product was made exactly the way the manufacturer intended, but the product is simply dangerous.
Now obviously, there are dangerous items that need to be made and used (e.g. lawn mowers). These items, however, should come with reasonable warnings to point out the possible dangers to consumers.
Defective Products: This is when a product was made or re-sold that is defective in such a way as to cause injury or harm to the end user. In this case, the design of the product isn't the problem.
The problem lies in the defect in a particular unit of the product. A missing bolt, a broken part or some other problem ultimately causes injury. The product could otherwise be completely safe, but one individual item causes problems or it could be an entire batch. A good example would be a recall of one particular batch of tires.
When an individual is injured because of a poorly designed or a defective product, the manufacturers or suppliers can be held liable for failing in their duty.
As the victim of an unsafe product, you may be entitled to lost wages, medical expenses, and compensation for pain and suffering. Consumer products liability refers to the liability of any or all parties along the chain of manufacture of any product for damage caused by that product.
This may include the manufacturer of component parts, an assembling manufacturer, the wholesaler, and the retail store. A product containing an inherent defect that causes harm to a consumer of the product, or anyone allowed to use the product, may have a products liability claim.
If you, or a loved one, have been injured as a result of a defective or dangerous product, please contact a personal injury attorney immediately to protect your legal rights.
